TO THE EXTENT PERMITTED BY APPLICABLE LAW, EXECUFIX'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO EXECUFIX IN THE THREE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

YOU AND EXECUFIX AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.
If you are a consumer in a jurisdiction that requires mandatory dispute resolution in local courts, this arbitration provision may not apply to you.
These Terms constitute the entire agreement between you and Execufix regarding your use of the Website and the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We may assign our rights and obligations under these Terms without your consent. You may not assign your rights under these Terms without our prior written consent.
